1. Eligibility

You must be at least the age of majority in your place of residence to make a purchase, or have the consent of a parent/guardian.

2. Products, drops & made-to-order

  • NYXA sells in limited, numbered drops; many pieces are made to order and are produced after purchase.
  • Ship-by dates for made-to-order/pre-order pieces are shown on the product page and at checkout. The wait is part of the product.
  • We aim to display colors, fabrics, and details accurately, but your screen may vary. Minor variation in handmade/made-to-order construction is normal and not a defect.
  • Quantities are limited and may sell out. We may limit quantities per customer.

3. Pricing & payment

  • Prices are in [USD] unless stated otherwise and may change at any time before purchase. Any "compare-at" price reflects our reference/original price, not necessarily a recent sale price.
  • Payment is taken via Shopify Payments / Shop Pay / PayPal at the time and in the manner described at checkout (including for pre-orders). You authorize us to charge your chosen payment method.
  • We reserve the right to refuse or cancel any order (including suspected fraud or pricing errors) and to refund you in such cases.

4. Shipping, returns & refunds

Shipping is governed by our Shipping Policy; returns and exchanges by our Refund & Returns Policy. Those policies are incorporated into these Terms.

5. Acceptable use

You agree not to misuse the Site — no unlawful, infringing, fraudulent, or abusive activity; no scraping, hacking, or interfering with the Site's operation or security.

6. Intellectual property

All content on the Site — including the NYXA name, the Ξ mark, 00:00 device, logos, designs, garment designs, copy, and imagery — is owned by or licensed to us and protected by IP laws. You may not copy, reproduce, or use it without our written permission. You may share your own photos of NYXA pieces and grant us a non-exclusive license to repost user content you tag or submit to us (e.g. for the "worn by" wall), with credit where practical.

7. User submissions & reviews

Anything you submit (reviews, photos, messages) must be yours to share and must not be unlawful or infringing. We may use, display, and remove submissions at our discretion.

8. Disclaimers & limitation of liability

The Site and products are provided "as is" to the fullest extent permitted by law. We don't guarantee the Site will be uninterrupted or error-free. To the maximum extent permitted by law, our total liability for any claim relating to a product is limited to the amount you paid for it. Nothing here excludes liability that cannot be excluded under applicable law, including your statutory consumer rights.

9. Indemnity

You agree to indemnify and hold NYXA harmless from claims arising out of your breach of these Terms or misuse of the Site.

10. Governing law & disputes
